Unless expressly stated otherwise, our products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and the Content does not constitute medical, health, or professional advice. Nothing on this site creates a doctor-patient relationship between you and True Compression Socks or any person featured on the site.

You should consult a qualified healthcare professional before using our products or acting on any Content, particularly if you have peripheral arterial disease, diabetes, peripheral neuropathy, congestive heart failure, a history of blood clots or deep vein thrombosis, skin infections or open wounds on your legs, or any other existing injury or medical condition, or if you are recovering from surgery, are pregnant, or are taking medication. Compression garments should be properly sized; a garment that is too tight or improperly worn can restrict circulation. If you experience increased pain, numbness, tingling, discoloration of the skin, increased swelling, skin irritation, or any adverse reaction while using our products or following any Content, discontinue use immediately and consult a physician.

You acknowledge that physical activity and the use of compression garments carry inherent risks. To the fullest extent permitted by law, you voluntarily assume all risks associated with your use of our products and Content, and you agree that any such use is at your own discretion and risk.

Testimonials and Results. Testimonials, reviews, and results described on this site reflect the individual experiences of specific customers and are not a guarantee, promise, or prediction of the results you will achieve. Individual results vary depending on many factors, including the nature and severity of your condition, consistency of use, proper sizing, and overall health.

SECTION 4 - ORDERS

When you place an order, you are making an offer to purchase. True Compression Socks reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until True Compression Socks confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as True Compression Socks may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e-mail, billing address, and/or phone number provided at the time the order was made. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order, including orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. Your purchases are subject to return or exchange solely in accordance with our Refund Policy (https://truecompressionsocks.com/policies/refund-policy). You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 5 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges. Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

SECTION 6 - SUBSCRIPTIONS AND RECURRING BILLING

Certain optional Services, including the True Compression Socks VIP Membership & [Program Name] (the "Membership"), are offered on a recurring subscription basis.

Free Trial. The Membership includes a 14-day free trial beginning on the date of purchase. If you do not cancel before the trial period ends, your Membership will automatically convert to a paid subscription.

Billing. After the free trial, the payment method used at checkout will be automatically charged $39 USD per month until you cancel. Billing occurs on a recurring monthly basis on or around the same calendar day each month. Prices are exclusive of any applicable taxes, which may be added at checkout. We reserve the right to change subscription pricing with at least 30 days' advance notice to active subscribers; continued use of the Membership after a price change takes effect constitutes acceptance of the new price.

Membership Benefits. While your Membership is active, you will receive access to the monthly [Program Name] materials and a discount code for 25% off future orders. Benefits, including discount codes, expire immediately upon cancellation or termination of your Membership and have no cash value.

Cancellation. You may cancel your Membership at any time through your customer account ("Manage Subscription") or by contacting us at support@truecompressionsocks.com. Cancellation takes effect at the end of the current billing period. You will retain access to Membership benefits until that date. No partial-month refunds are provided, except where required by law.

Failed Payments. If a recurring payment fails, we may retry the charge and/or suspend your Membership benefits until payment is successfully processed.

SECTION 7 - CHARGEBACKS AND PAYMENT DISPUTES

If you have a question or concern about any charge on your account, including subscription charges, you agree to first contact us at support@truecompressionsocks.com and give us a reasonable opportunity to resolve the issue before initiating a chargeback or payment dispute with your bank or card issuer. We are committed to resolving billing issues quickly, and most concerns can be settled with a refund or correction within a few business days. Initiating a chargeback on a valid, properly disclosed charge may result in the suspension or termination of your account, Membership, and access to our Services. We reserve the right to dispute any chargeback we believe to be invalid and to provide the card issuer with evidence of the transaction, our disclosures, and your acceptance of these Terms.

SECTION 8 - SHIPPING AND DELIVERY

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

SECTION 9 - INTELLECTUAL PROPERTY AND LIMITED LICENSE

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product designs, product reviews, video, and audio, all Membership and [Program Name] materials (guides, routines, tips, and related content), and the design, selection, and arrangement thereof, are owned by True Compression Socks, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.

Subject to your compliance with these Terms and, where applicable, payment of your Membership fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services and Content for your own personal, non-commercial use. You must not reproduce, distribute, share, modify, create derivative works of, publicly display, publicly perform, republish, download, store, sell, resell, sublicense, or transmit any of the material on the Services without our prior written consent. This includes, without limitation, sharing or forwarding Membership materials to non-members. This license terminates automatically when your Membership ends or if you breach these Terms, and you must cease use of any Membership materials upon termination.

Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of True Compression Socks, Shopify or any third party. Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by True Compression Socks. True Compression Socks's names, logos, product and service names, designs, and slogans are trademarks of True Compression Socks or its affiliates or licensors. You must not use such trademarks without the prior written permission of True Compression Socks. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. True Compression Socks is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with True Compression Socks. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and True Compression Socks, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with True Compression Socks.

SECTION 13 - PRIVACY POLICY

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. The following sections will continue to apply following any termination: Medical Disclaimer; Assumption of Risk, Chargebacks and Payment Disputes, Intellectual Property and Limited License, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Dispute Resolution; Binding Arbitration; Class Action Waiver, Privacy Policy, and any other provisions that by their nature should survive termination.

EXCEPT AS EXPRESSLY STATED BY TRUE COMPRESSION SOCKS, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

SECTION 20 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL TRUE COMPRESSION SOCKS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

SECTION 21 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless True Compression Socks, Shopify, and our parent, affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

SECTION 22 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 23 - WAIVER; ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). SECTION 25 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Subject to Section 26, you and True Compression Socks consent to venue and personal jurisdiction in the federal and state courts located in the State of Wyoming.

SECTION 26 - DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO PARTICIPATE IN A CLASS ACTION.

Informal Resolution First. Before filing any claim, you agree to first contact us at support@truecompressionsocks.com with a written description of your dispute and give us 30 days to attempt to resolve it informally. Most disputes can be resolved this way.

Binding Arbitration. If we cannot resolve a dispute informally, you and True Compression Socks agree that any dispute, claim, or controversy arising out of or relating to these Terms, our products, our Services, or your Membership shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be the State of Wyoming, United States; however, you may elect to participate in the arbitration by telephone or video conference, or, where the AAA rules permit, to have the arbitration decided on written submissions. Judgment on the arbitration award may be entered in any court having jurisdiction. This agreement to arbitrate is governed by the Federal Arbitration Act.

Class Action Waiver. YOU AND TRUE COMPRESSION SOCKS EACH AGREE THAT ANY DISPUTE WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights.

Opt-Out. You may opt out of this arbitration agreement and class action waiver by emailing support@truecompressionsocks.com within 30 days of your first purchase, stating your name, order number, and that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

Severability of this Section. If the class action waiver is found to be unenforceable, then the entirety of this Section 26 shall be null and void, and the dispute shall be resolved in accordance with Section 25.

It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
